Terms of Service

1. Agreement

These Terms govern your use of pointclickfit.com and our apps (the "Site") and any account you create or advertising you buy from PCF, LLC, doing business as PointClickFit ("PointClickFit," "we," "us"). By using the Site, creating a business account, or buying advertising, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

2. What PointClickFit is

PointClickFit is an independent directory of health clubs, fitness studios, clinics and similar businesses. We compile listings from public sources. We don't own or operate the listed businesses, and a listing is not an endorsement. Ratings, review counts and "Best Of" rankings are based on public data and a published scoring method; they can be incomplete or out of date. Listings may contain errors, so please confirm details (hours, prices, services, whether a business is open) with the business directly. We don't guarantee the accuracy, completeness or availability of any listing.

3. Listings and claiming

• Every business receives a free listing automatically. Visitors don't need an account.
• Claiming: a person with authority to act for a business can create a free account and claim its listing. By claiming, you confirm you are that person and the information you give us is accurate.
• We review every claim and approve it within 1–2 business days. We may decline, delay, or reverse a claim, for example if we can't confirm your connection to the business.
• Owners can't edit listings themselves. To correct something in a listing, contact us and we'll update it.
• We may correct, edit, merge or remove any listing at our discretion.

4. Business accounts

You're responsible for keeping your login secure and for everything done through your account. Tell us promptly if you suspect unauthorized use. We may suspend or close an account that violates these Terms.

5. Pay-per-click advertising

• How it works: once your claim is approved, you can turn on advertising, add a payment method and set a monthly budget. Advertising businesses are ranked above free listings in their city's list.
• What you pay: a fixed rate for each click on your listing's Visit Website button. The founding rate is $1.00 per click for your first 90 days as an advertiser. After that, standard rates apply, and we'll notify you before a rate change affects you.
• Your budget is a hard cap. We never charge more than your monthly budget for clicks. Once it's reached, we stop counting billable clicks until the next month.
• Billing: clicks are totalled and charged once a month to your saved payment method. If a charge fails, the unbilled clicks stay unbilled and are charged on the next run once payment succeeds.
• Invalid clicks: we filter automated and suspicious traffic. If we later find invalid clicks, we credit them. You agree not to click your own listing's link to run up or avoid charges, or use bots or other means to generate clicks.
• You can pause or stop advertising anytime from your dashboard. Your free listing stays up.

6. Spotlight and Featured add-ons

• Spotlight (an orange tag, outline and map star on your listing) and Featured (a place in the showcase above the map, with a purple star) are separate paid add-ons, billed as a flat monthly fee separate from your click budget. They require an active pay-per-click account. You may buy either one or both.
• Featured spots are limited to 5 per city, filled first come, first placed, in a fixed order. If you cancel or your Featured placement lapses, you lose your place and return to the back of the line if you sign up again.
• Add-ons are set up on request. We'll contact you to confirm and start your plan.
• If a payment for an add-on fails, your placement pauses after a 7-day grace period until payment succeeds.
• Prices and availability may change. We'll tell you before a price change affects you.

7. Payments

Payments are processed by Stripe. You enter your card details in a secure Stripe form; your full card number never passes through our servers. We keep only your card brand, the last four digits and a Stripe reference. By saving a payment method you authorize us to charge it for advertising you've agreed to, including recurring monthly charges. You're responsible for any applicable taxes. Stripe's terms and privacy policy also apply to your use of its service.

8. Cancellation and refunds

• Pay-per-click: pause or stop anytime. Clicks that were real and delivered are not refunded, and invalid clicks are credited.
• Spotlight and Featured: month to month with no contract. You can cancel anytime. A cancelled add-on stays active until the end of the month you've already paid for. We don't refund partial months.
• Our errors: if a placement didn't run because of an error on our side, we'll credit that period.
• To cancel an add-on, use the Cancel button in your dashboard or contact us.

9. Acceptable use

Don't misuse the Site: no scraping or copying the directory at scale, no interfering with its operation or security, no false or misleading claims about a business, no click fraud, and no use that breaks the law.

10. Content you give us

If you send us information about your business (corrections, descriptions, links), you give us permission to use it in the directory. You confirm you have the right to share it.

11. Disclaimers

The Site and listings are provided "as is" and "as available," without warranties of any kind. We don't promise any particular amount of traffic, clicks, visitors or customers from advertising. We don't guarantee the Site will always be available or error-free.

12. Limitation of liability

To the fullest extent the law allows, PCF, LLC (PointClickFit) isn't liable for indirect, incidental or consequential damages, or for lost profits, arising from your use of the Site or our advertising. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. Nothing here limits liability that can't be limited by law.

13. Changes and termination

We may update these Terms. When we make a meaningful change, we'll update the date at the top of this page and, for advertisers, tell you by email. Continuing to use the Site or advertising after a change means you accept it. We may suspend or end access to the Site, an account or advertising for violations of these Terms.

14. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Lake County, Illinois, and you consent to those courts' jurisdiction.
